1           Bookings

1.1                    All bookings must be made in writing on the form attached, and are subject to these Terms and Conditions. Provisional bookings may be made by telephone and indeed are encouraged to ensure that the accommodation is available on the dates required. A provisional booking will be held for 7 days pending receipt of a completed booking form and the full deposit payable.

1.2                    A non-refundable deposit of £200.00/$300.00 per week confirms your booking.

1.3                    A provisional booking will not constitute a firm reservation until we have received the completed booking form and deposit and subsequently confirmed the deposit to you in writing.

1.4                    For the safety and comfort of clients both present and future, and the degradation and soiling caused to materials and paintwork etc. in the villa, which would be caused by smoking, bookings will only be accepted if it is agreed that there will be no smoking in the villa. No exceptions will be made.

1.5                    Due to the high standard of the contents and facilities in the villa, an additional security deposit will be required by the swiping of a credit card, by our management company to cover breakages or damage to the premises and or its contents, telephone bills and cleaning costs other than those normally expected in connection with the occupations of the villa. The management company will call upon this, subject to any deductions, to cover any of the above after inspection.

1.6                    Upon signing the rental agreement and the security deposit form, the signatory agrees to pay any damage of any kind to the property (from the security deposit). This deposit is fully refundable after your departure from the property, providing there are no claims made against it. In the event of any excess damage of any kind to the property or excess cleaning costs or excessive use of electricity, (e.g. due to leaving external doors open with air-conditioning on) which exceed the security deposit the Signatory will be held responsible for all additional costs..

1.7                    At the time of full and final payment a £250/$375 (two hundred and fifty pounds/three hundred and seventy five US dollars) refundable security deposit is also required. This deposit will be refunded net of any excess cleaning costs, replacement of lost keys or repairds to any damage to the property or its contents. This deposit less any charges will be refunded within 30 days from the date of your departure from the property. Please note damages are not limited the security deposit amount (see clause 1.5).

1.8                    The balance is due 8 weeks before the date you arrive at the Villa.

1.9                    Bookings made within 8 weeks of arrival are payable in full at the time of booking.

1.10                 All prices are fully inclusive of tax and utilities.

2           Cancellation

2.1                    In the event of unforseen circumstances, cancellation must be notified in writing by the person whose name appears on the booking form.

2.2                    You may cancel the booking at any time subject to cancellation charges.

2.3                    Cancellation must be in writing, we reserve the right to cancel the booking if payments has not been received on the agreed dates.

2.4                    The following cancellation charges apply to all rentals:-

2.4.1                    Any cancellation 10 weeks or more prior to arrival – 50% of  reservation deposit.

2.4.2                    8 to 10 weeks prior to arrival –100 of reservation deposit.

2.4.3                    4 to 8 weeks prior to arrival – 50% of total rental charge.

2.4.4                    Less than 4 weeks prior to arrival – 100% of total rental charge.

2.5                    We strongly recommed that you take out Insurance Cover to protect against cancellation.

3           Alterations by the guest

3.1                    If once the booking has been accepted, the guest wishes to make any alterations to the booking detail, we will do all we can to assist you provided that the request is made in writing (e-mail is acceptable) by the person who has signed the booking form.

3.2                    Some alterations may incur an administrative fee of £25.

3.3                    Material alterations my be treated as a cancellation.

3.4                    Any alterations made less than nine (9) weeks before the date of arrival, may be treated by us as a cancellation and so subject to the cancellation charges, outlined in xxx above.

4           Cancellation by us.

4.1          In the unlikely event of cancellation by us we will refund you as soon as reasonably practical and fully refund you any moneys you have paid.

5           Right of entry

5.1          It is understood and agreed that the owner or agent shall have the right to enter and inspect premises at all reasonable times to ensure maintenance and safety of the premises.

6           Insurance

6.1          All clients are required to have adequate Holiday Insurance Cover for the entire rental period. This you will need to arrange yourselves through a reputable Insurance Company.

7           Liability

7.1          The owners and the Management Company of the property accept no responsibility whatsoever for death, personal injury, accidents, loss or damage to persons or personal belongings however caused. The use of all accommodation, all equipment provided and all amenities, including the pool is entirely at the users’ own risk. Children must be supervised at all times by responsible adults particularly when using the swimming pool. GLASS is not permitted within the pool area. The Owners or Management Company cannot accept any liability for any loss of rental time due to to travel problems, flight delays or cancellations, industrial disputes, failure of any equipment within the Villa or any events which are outside our control, including any Force Majeure.

8           Responsibilities

8.1          The guests are responsible for the property, and are expected to take all reasonable care of it, including the locking of all doors and windows whenever the Villa is unoccupied..

9           Party size.

9.1          Everyone occupying the property must be listed on the booking form, this includes small children. This is Florida state law and must be adhered to. The accommodation cannot be shared, assigned or sub-let and only the persons shown on the booking form are permitted to stay in the property. No pets are permitted. Persons under 21 years of age are not acceptable unless accompanied by parents or responsible adults. This property is fully licencsed for short term rental in Florida. The Owners reserve the right to refuse admittance if this condition is not met. Failure to comply will render the booking void and no compensation will be paid.

10        Accommodation.

10.1       Subletting, sharing or assigning is strictly prohibited.

10.2       The villa will be available to guests after 4:00 pm Florida time on the day of arrival, unless otherwise agreed.

10.3       The Villa must be vacated by 10:30 am Florida time on the day of departure, unless otherwise agreed.

10.4       A surcharge of one days rental will be charged if the Villa is not vacated by the specified time.

10.5       Only the persons shown on the booking form are permitted to stay in the property.

11        Purchase of pool heat.

11.1       In the event that weather conditions fall below 50 (fifty) degress Fahrenheit, the pool heating will automatically shut off to prevent damage

11.2       We find it unreasonable to expect to use the swimming pool while the outside ambient temperature is below 50 (fifty) degress Fahrenheit.

12        Animals and Pets

12.1       Animals and Pets are not permitted in the Villa.

12.2   Service and guide animals are allowed.

13        Force Majeure

13.1       As with any other holiday, there may be circumstances completely beyond our control and contemplation, in which the property might not be available for your booking. Examples of these circumstances include (but are not limited to) destruction of or severe damage to the property. Such circumstances are referred to as ‘Force Majeure’. In the event of Force Majeure, the Owners will do their best to make alternative arrangements for you where possible. If they cannot, or if alternative arrangements are unacceptable to you, then they will refund all monies paid. This will be the full extent of the Owners liability to you in such circumstances, and they shall not be responsible for any other costs connected with any such cancellation, however arising.

14        Insects and Pests

14.1       Insects and pests are inevitably present in the Florida climate. Within reason, this is normal and we cannot take action to eradicate it.

14.2       The villa receives periodic pest control treatment. Only when, in our reasonsable opinion, pests in the living accommodation are a serious nuisance will further action be taken.

15        Brochure Description.

15.1       All brochure descriptions are made in good faith and every care taken to ensure their accuracy, but no liability will be accepted in the event of any error.

16        Complaints

16.1       In the unlikely event that the guest has any reason for complaint or dissatisfaction, they must contact our management company, Doral Woods Management on 407 9313295, so that speedy and remedial action is taken.

16.2       If the management company for any reasons deems the complaint as ‘unjustified/unwarranted’ a £50 charge per call out will be payable..

17        Accuracy of information.

17.1       A great deal of care has been taken to ensure the accuracy of information we have provided. However, facilties and services may not be open or available due to renovation/maintenance works, adverse weather etc. Where we are aware that a facility or service advertised in the information provided will not be available during the period of your stay, we will take steps, wherever possible, to notify you prior to travel. Some furniture may also differ to that advertised.

17.2       We reserve the right to reasonably amend any of the terms and conditions set out herewith.

18        Governing Law

18.1       The laws of England and Wales shall apply to this contract and any other claims.
